    Terms of Service

Blep is operated by MakeFox Group, Inc.
    Effective Date: November 4, 2026

    1. Agreement and Eligibility

These Terms of Service ("Terms") govern access to and use of Blep (the "Platform"), an online service owned by MakeFox Group, Inc. ("MakeFox," "we," "us," or "our"), a nonprofit corporation organized in the United States.

By accessing or using the Platform, you agree to these Terms and our applicable Content Policy (the Code of Conduct and Uploading Guidelines), Privacy Policy, and Copyright & Takedown Policy.

The Platform is available exclusively to individuals who are at least 18 years old. By using the Platform, you represent that you meet this requirement and are legally capable of entering into this agreement.

If you use the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not use the Platform.

    2. Description of Services

Blep is a digital media hosting, organization, and discovery platform operated by MakeFox Group, Inc., a nonprofit organization engaged in artificial intelligence research and development.

In addition to providing public access to user-submitted artwork, images, videos, and AI-generated media, the Platform supports research into artificial intelligence, generative media, content classification, tagging systems, and related technologies.

The Platform may offer user accounts, content submissions, tagging, search functionality, content filtering, commenting, and related features.

MakeFox may modify, suspend, discontinue, or restrict Platform features or services at its discretion, subject to applicable law. We do not guarantee uninterrupted availability, permanent storage, or continued access to any particular content or functionality.

    3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.

You agree to provide accurate registration information, maintain reasonable account security, and promptly notify us of suspected unauthorized access.

Accounts may not be transferred, sold, or shared without our authorization.

MakeFox may suspend, restrict, or terminate accounts that violate these Terms, threaten Platform security, or otherwise present unacceptable operational or legal risks.

    4. Intellectual Property

    4.1 Platform Intellectual Property

Except for User Content and third-party materials, the Platform's software, design, branding, documentation, and other proprietary elements belong to MakeFox or its licensors.

We grant users a limited, revocable, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms.

This license does not transfer ownership of Platform intellectual property.

    4.2 User Content

"User Content" means any images, videos, artwork, text, metadata, tags, descriptions, comments, or other materials submitted to the Platform.

Users retain whatever intellectual property rights they lawfully possess in their User Content.

Submitting content does not transfer copyright ownership to MakeFox.

However, submission grants MakeFox the license described below.

    4.3 License to User Content

By submitting User Content, you grant MakeFox Group, Inc. a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to use, host, store, reproduce, distribute, publicly display, publicly perform, publish, transmit, modify, adapt, translate, index, classify, and create derivative works from that content.

This license applies in all media, formats, and technologies, whether currently existing or developed in the future.

The license includes the right to:

    • (1) Operate, maintain, improve, and promote the Platform.
    • (2) Generate thumbnails, previews, alternative formats, and derivative representations.
    • (3) Index, categorize, classify, and analyze submitted materials.
    • (4) Display and distribute content through the Platform, associated services, and authorized integrations.
    • (5) Conduct lawful research, including research involving artificial intelligence, machine learning, and digital media.
    • (6) Use content in promotional, educational, archival, and other lawful activities consistent with MakeFox's purposes.
    • (7) Authorize contractors, infrastructure providers, research collaborators, and other third parties to exercise licensed rights on MakeFox's behalf or through authorized sublicenses.

This license survives deletion of User Content, account termination, and discontinuation of the Platform.

MakeFox may voluntarily remove content from public availability upon request but is not contractually obligated to relinquish rights previously granted under this license.

The license extends only to rights the submitting user lawfully possesses or is authorized to grant. It does not create rights in material that is otherwise unprotected or owned by another party.

    4.4 User Representations

By submitting User Content, you represent and warrant that:

    • You possess the rights or permissions necessary to submit the material and grant the foregoing license.
    • Your submission does not knowingly violate applicable law or the enforceable rights of another person.
    • Your submission complies with the Platform's published content requirements.
    • You have obtained any legally required consent for the use of identifiable individuals' likenesses or other protected personal attributes.

You remain responsible for your submissions and any legal claims arising from them.

    4.5 AI-Generated Content

The Platform permits AI-generated and AI-assisted media.

MakeFox does not represent that AI-generated content is necessarily eligible for copyright protection or that every submission is free from third-party rights.

Users are responsible for determining whether they possess sufficient rights to submit and license their materials.

Nothing in these Terms constitutes a determination of copyright ownership, authorship, or infringement.

    5. Content Standards

The Platform may host fictional, artistic, mature, and sexually explicit material, subject to applicable law and our Content Policy.

All User Content must comply with the Platform's published rules.

Users may not submit or distribute:

    • Material prohibited by applicable law.
    • Content that infringes enforceable intellectual property rights.
    • Unlawful intimate imagery, including applicable categories of nonconsensual AI-generated intimate depictions.
    • Material involving the actual sexual exploitation or abuse of minors.
    • Content intended to threaten, harass, defraud, or unlawfully exploit identifiable individuals.
    • Malware, malicious code, or material intended to compromise Platform security.
    • Content otherwise prohibited by our published Content Policy.

Fictional or artistic depictions are not automatically treated as endorsements of the conduct depicted. Nevertheless, MakeFox may prohibit or remove particular categories of fictional content regardless of whether the material is unlawful.

Detailed content classifications, restrictions, and submission requirements are maintained in the Content Policy.

    6. Content Classification and Filtering

The Platform may classify content using tags, ratings, maturity designations, or other descriptive metadata.

MakeFox reserves the right to create, modify, merge, remove, or correct classifications and tags.

Users may be offered filtering tools to customize the content they view.

Content filters and classifications are provided for convenience and are not guarantees that material is suitable, accurately categorized, or lawful in every jurisdiction.

MakeFox may restrict access to particular content, categories, accounts, or geographic regions when reasonably necessary for legal compliance or Platform operations.

Users must not circumvent access restrictions, security measures, or legally required verification systems.

6.1 Age Verification and Geographic Restrictions

MakeFox may require users to verify their age or eligibility before accessing the Platform or particular categories of content, including where required by applicable law.

Verification may be conducted directly by MakeFox or through an authorized third-party provider. Verification procedures, information collection, retention, and disclosure shall comply with applicable law and the Platform's Privacy Policy.

MakeFox reserves the right to restrict or prohibit access to the Platform, specific features, or categories of content based on a user's geographic location, applicable legal requirements, or the availability of compliant verification mechanisms.

Users may not circumvent age-verification requirements, geographic restrictions, or other access controls implemented for legal compliance.

    7. Moderation and Enforcement

MakeFox retains authority to review, restrict, remove, reclassify, or disable access to User Content.

We may take these actions when content:

    • Violates these Terms or another applicable Platform policy.
    • Is reasonably suspected of violating applicable law.
    • Presents security, privacy, or operational concerns.
    • Is the subject of a credible legal complaint.
    • Creates unacceptable risk to MakeFox, its users, or third parties.

MakeFox may also suspend or terminate accounts and restrict access to Platform services.

We are not obligated to review every submission before publication and do not guarantee the immediate detection or removal of objectionable material.

Nothing in this section limits obligations imposed by applicable law.

    8. Copyright and Takedown Procedures

MakeFox respects intellectual property rights and maintains procedures for addressing copyright complaints under the Digital Millennium Copyright Act ("DMCA").

Copyright owners and their authorized representatives may submit notices of alleged infringement through our designated copyright agent.

Our Copyright & Takedown Policy describes the required contents of notices, counter-notification procedures, and our repeat-infringer policy.

MakeFox may remove or disable access to allegedly infringing material and may terminate repeat infringers in appropriate circumstances.

    9. Privacy and Personal Information

Our Privacy Policy explains how personal information is collected, used, retained, and disclosed.

By using the Platform, you acknowledge the data practices described in that policy.

MakeFox may disclose information when required by applicable law, valid legal process, or other lawful obligations.

We may also disclose information where legally permitted and reasonably necessary to protect the Platform, enforce our policies, or address security incidents.

    10. Acceptable Use and Platform Security

    Users must not:

    • (1) Access accounts, systems, or data without authorization.
    • (2) Interfere with Platform operations or other users' access.
    • (3) Introduce malware or conduct denial-of-service attacks.
    • (4) Use the Platform for unlawful fraud, impersonation, or harassment.
    • (5) Evade account suspensions or technical access restrictions.
    • (6) Misrepresent affiliation with MakeFox or another organization.
    • (7) Conduct unauthorized bulk collection or automated activity contrary to published technical requirements.

Automated access may be permitted when conducted in accordance with our published API guidelines, technical restrictions, and applicable law.

MakeFox may limit automated requests to preserve service reliability and security.

    11. Third-Party Services and External Links

The Platform may contain links to third-party websites, advertisements, services, or resources.

MakeFox does not control third-party services and is not responsible for their content, security, availability, or privacy practices.

Your use of third-party services is governed by their respective terms and policies.

Links do not imply endorsement, sponsorship, or affiliation unless expressly stated.

    12. Availability, Accuracy, and Data Retention

The Platform is provided as an online hosting and discovery service.

    MakeFox does not guarantee:

    • Permanent retention of submitted materials.
    • Continuous service availability.
    • Accuracy of user-submitted information.
    • Preservation of account history or metadata.
    • Recovery of deleted or corrupted content.

Users should maintain independent copies of materials they wish to preserve.

MakeFox may retain content, records, or backups following deletion or account termination when permitted or required by applicable law, consistent with the Privacy Policy and the rights granted under these Terms.

    13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

MakeFox disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.

We do not warrant that the Platform will be uninterrupted, secure, error-free, or free from harmful components.

We do not guarantee the accuracy, legality, reliability, or suitability of User Content.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

    14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKEFOX AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE PLATFORM.

This exclusion includes, where legally permitted, lost profits, business interruption, loss of data, and loss of goodwill.

To the maximum extent permitted by applicable law, MakeFox's aggregate liability to a user for claims arising from or relating to the Platform will not exceed the greater of:

    • The amount the user paid MakeFox for Platform services during the twelve months preceding the event giving rise to the claim; or
    • One hundred U.S. dollars ($100).

These limitations apply regardless of the legal theory asserted, except where prohibited by law.

Nothing in this section limits liability that cannot lawfully be limited or excluded.

    15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MakeFox and its directors, officers, employees, agents, contractors, service providers, and affiliates against third-party claims, damages, liabilities, and reasonable legal expenses arising from:

    • (1) Your User Content.
    • (2) Your infringement or misappropriation of third-party rights.
    • (3) Your material violation of these Terms.
    • (4) Your unlawful use of the Platform.

This obligation does not apply to the extent a claim results from MakeFox's own unlawful conduct or other circumstances for which indemnification is prohibited by law.

MakeFox may participate in the defense of a covered claim through counsel of its choosing.

    16. Governing Law

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles.

The Platform is operated under the authority of MakeFox Group, Inc., a Texas-based organization.

Unless a dispute is subject to arbitration or applicable law requires otherwise, proceedings arising from these Terms shall be brought in a court of competent jurisdiction serving Lubbock County, Texas.

The parties consent to the jurisdiction of those courts to the extent permitted by law.

    17. Dispute Resolution and Arbitration

    17.1 Informal Resolution

Before initiating formal proceedings, either party must provide written notice describing the dispute and requested relief.

The parties will attempt in good faith to resolve the dispute for at least thirty days after receipt of notice.

Notices to MakeFox may be sent to:

    MakeFox Group, Inc.
    PO Box 277
    Slaton, TX 79364

A user may also contact management@blep.art to initiate informal dispute resolution.

    17.2 Binding Arbitration

For users located in the United States or Canada, disputes arising from or relating to these Terms or the Platform shall be resolved through binding individual arbitration, except where applicable law prohibits arbitration or permits an exception.

Arbitration shall be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, as modified by these Terms where legally permissible.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Arbitration may be conducted remotely where permitted by the applicable rules.

The arbitrator may award relief available under applicable law.

    17.3 Class-Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND MAKEFOX AGREE THAT DISPUTES SUBJECT TO ARBITRATION WILL BE RESOLVED INDIVIDUALLY, NOT THROUGH CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDINGS.

Neither party may participate as a class representative or class member in an arbitrable dispute.

If this waiver is unenforceable as to a particular claim or form of relief, that issue shall be addressed in accordance with applicable law.

    17.4 Exceptions

Either party may bring an eligible claim in small-claims court.

Nothing in these Terms prevents a party from seeking relief that cannot lawfully be subjected to arbitration.

The arbitration agreement does not restrict the authority of government regulators or law-enforcement agencies.

17.5 Users Outside the United States and Canada

For users outside the United States and Canada, disputes not otherwise subject to mandatory arbitration shall be resolved in the state or federal courts serving Lubbock County, Texas, to the extent permitted by applicable law.

Mandatory consumer protections applicable in a user's jurisdiction remain unaffected where they cannot lawfully be waived.

    18. Time Limits for Claims

To the extent permitted by applicable law, contractual claims arising under these Terms must be initiated within one year after the claim accrues.

This provision does not shorten a statutory limitation period where doing so is prohibited by law or interfere with nonwaivable legal rights.

    19. International Access

MakeFox operates the Platform from the United States.

We do not represent that all Platform content or functionality is lawful or appropriate in every jurisdiction.

Users accessing the Platform from other jurisdictions are responsible for complying with applicable local laws.

MakeFox may restrict access in particular locations to comply with legal obligations or reduce operational risks.

    20. Changes to These Terms

MakeFox may revise these Terms to reflect changes in law, Platform functionality, or operational requirements.

The current version will be published on the Platform with its effective date.

Where reasonably practicable, we will provide advance notice of material changes through the Platform or registered users' contact information.

Material changes will apply prospectively unless applicable law requires otherwise.

Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

Changes requiring affirmative consent will not become binding without that consent.

    21. Termination

You may discontinue using the Platform at any time.

MakeFox may suspend or terminate access in accordance with these Terms.

Termination does not affect accrued rights, outstanding obligations, or provisions intended to survive termination.

Surviving provisions include intellectual property licenses, indemnification, limitations of liability, dispute resolution, and other provisions that by their nature remain applicable.

    22. General Provisions

    Severability
If any provision is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

    No Waiver
Failure to enforce a provision does not constitute a waiver of the right to enforce it later.

    Assignment
You may not assign your rights or obligations under these Terms without MakeFox's written consent.

MakeFox may assign these Terms in connection with a lawful transfer, restructuring, or succession of its operations, subject to applicable law.

    Entire Agreement
These Terms, together with applicable incorporated policies, constitute the entire agreement between you and MakeFox concerning the Platform.

They supersede prior agreements or representations concerning the same subject matter, except where expressly preserved.

    Headings
Section headings are provided for convenience and do not alter the meaning of these Terms.
